Cuddle Avenue Playroom Rules

  • Each participant must wear non-slip socks to prevent an accident fall. Shoes are prohibited!
  • Limit 3 children per adult
  • All children must be accompanied and supervised by parent/guardian
  • Children must always be accompanied into the restrooms – no exceptions
  • No food or beverage inside the playground
  • Always be respectful to other children; do not push, injure, hit, or bully other children and follow instructions
  • Remember that words can also hurt. Name-calling and cursing are inappropriate behavior and will not be permitted
  • Kids must behave regardless of age, if they do not behave or become violence, THEY WILL BE ASKED TO LEAVE and no refunds will be given
  • Play with SAFETY in mind at all times
  • We are a nut free facility. Please do not bring or consume any nuts or products that contain nuts in our facility
  • Children will share and/or take turns with all playground equipment
  • We are not responsible for lost or stolen personal property
  • Remove shoes, hair clips, and sharp objects before using the playground
  • Out of respect for others, please ensure your child is free of sickness before visiting us
  • Parents are expected to enforce the rules
  • For your own safety, please report any incident to the manager on duty
  • YOUR CHILDREN ARE YOUR RESPONSIBILITY and must obey the playground rules
  • All people entering the premises must sign the Assumption of Risk, Waiver, and Release from Liability document
  • Cuddle Avenue Playroom reserves the right to amend the rules herein at any time without any prior notice
  • Cuddle Avenue Playroom reserves the right to request any guest to leave the playground without any refund

Cuddle Avenue Class Rules:

  • Saturday classes are good for ages 18 months old up to 5 years old.
  • Children as young as 6+ months are invited to join our music class. Smaller children will enjoy watching the bigger kids have fun.
  • Children as young as 8+ months are invited to join our French class.
  • Classes are 45 minutes long.
  • Drop-in class and semester options available. Drop-in sessions subject to availability.
  • Sibling discount available.
  • Adult participation required.
  • Face masks are optional at this time for children and adults.
  • PLEASE NOTE: There are NO REFUNDS for any classes. Rescheduling is subject to availability and an advanced notice of 24-hour sent by email is required.

Cuddle Avenue Playroom Policies

Age:

  • Cuddle Avenue Playroom indoor play space is offered throughout the day for children aged 0-5 years old.

Supervision:

  • Children using the indoor play space must be accompanied by their parent/legal guardian or authorized caregiver at all times. "Drop offs" are not permitted. This is to ensure children do not hurt themselves and are following the playspace rules. Parent/Guardian will assume full responsibility for his/her own safety and conduct, and the supervision, safety, and conduct of his/her child(ren), while on or about Cuddle Avenue Playroom.
  • Limit 3 children per adult.
  • All children must always be accompanied into the restrooms.
  • We do not tolerate bullying, fighting and/or rough play at Cuddle Avenue Playroom premises and reserves the right to refuse admittance to any individual involved in actions disrespecting others. Any individual violating this policy will be asked to exit the premises and will not be entitled to a refund of any amounts incurred in connection with the activities.

Schedule & Closings:

  • Cuddle Avenue Playroom is open on weekends from 10 AM to 6:30 PM. Any changes in schedule due to holidays, birthday and other special events, inclement weather etc. are published on our social media outlets.
  • Cuddle Avenue Playroom reserves the right to open and close the premises or any portion of the Playspace in its sole and absolute discretion. Posted hours are subject to change without prior notice for construction, maintenance, special events, holidays, or other purposes. In the event a portion of the Playspace is closed, I agree I shall not be entitled to a refund of any amounts, including pro rata with respect to such closed portion(s).

Playspace:

  • We ensure the playspace is sanitized properly so that you can enjoy your experience. Playspace is disinfected in between each play session and before and after the end of each operating day. We will continue to disinfect surfaces and toys throughout the day.
  • Please read all signs posted throughout Cuddle Avenue Playroom and note the
  • age restrictions in each exhibit/play area.
  • Cuddle Avenue Playroom will make reasonable efforts to monitor and reserves the right to limit the number of people who occupy any area of Cuddle Avenue Playroom.
  • NO PRIVATE PARTIES/BIRTHDAY PARTIES OR SIMILAR GATHERINGS ARE ALLOWED DURING OPEN PLAY HOURS. THERE IS NO BIRTHDAY CAKE/TREATS AND DECOR ALLOWED DURING OPEN PLAY HOURS ON THE CUDDLE AVENUE PLAYROOM PREMISES.
  • Please respect the equipment, the toys, and others. No sharp or glass objects allowed in the Playspace or Cuddle Avenue Playroom premises.
  • Our facility is designed for children 5yr and under. Children over 5yr will NOT be permitted to play or stay in the facility. ​
  • Any individual desiring entrance to the Playspace and participation in the Activities, including parents, guardians, or other individuals over eighteen (18) years of age, must agree to the terms and conditions herein in order to gain entry.
  • No Smoking. Smoking is strictly prohibited at State of Play.

Reservation:

  • Reservations are required for each visitor: children, adults & infants.
  • Single Session is valid for one visit only.
  • Open Play passes expire 2 months from the day of purchase. No refund will be issued for unused passes.

Checking In & Duration of Visit:

  • Families may arrive at any point during their reservation block and must exit the facility by the end of their scheduled block.
  • Upon arrival, please remove shoes and check in with a Cuddle Avenue Playroom staff member to sign your required waivers.
  • A one time waiver of responsibility is required to be signed before a child enters the playspace area. To save time during your initial visit, you may fill out the waiver ahead of time via the waiver form below.
  • Guests will be required to check in with front desk staff upon entering a Cuddle Avenue Playroom location. Please note that we do not accept cash onsite.
  • We cannot accommodate early arrivals or offer prorated refunds for any unused time in a reservation block.

Food & Drink:

  • Food and beverages are not allowed in the playspace and must be kept in the cubbies during your visit.
  • We are a nut free facility. Please do not bring or consume on premises any nuts or products that contain nuts.
  • Eating or drinking must be done in the lounge area ONLY.

Shoes & Socks:

  • All adults and children must remove their shoes and wear socks inside the play area.
  • Each participant (parents/guardians & children) must wear non-slip(gripper) socks in the playspace all the time to prevent accident fall. Gripper socks are available for purchase.
  • Cuddle Avenue Playroom reserves the right to refuse entrance to the playspace to anyone who does not have the proper footwear.

Strolers:

  • Designated stroller parking is available inside Cuddle Avenue Playroom at the front of the cafe area. We encourage parents to fold the strollers when possible and leave them in the designated area.
  • Due to fire safety regulations, no strollers are allowed inside Cuddle Avenue Playroom premises.

Personal Belongings:

  • Cuddle Avenue Playroom is not responsible for lost or stolen items.
  • Any personal property left on the premises and handed in to a Cuddle Avenue Playroom staff member will be retained for thirty (30) days. After this time, Unclaimed items left behind will be donated or disposed of.

Animals and Items from Home:

  • To help provide a safe environment, live animals other than service animals are not permitted on Cuddle Avenue Playroom premises. Children are not allowed to bring objects that may be a safety hazard, such as toys, jewelry, food or anything that may present a choking or strangulation hazard.
  • Transitional objects such as blankets, stuffed animals or pacifiers are welcome.

Cell Phones:

  • Please do not allow the use of cell phones to detract from your ability to supervise your child. State of Play requests that ringers be turned to silent or vibrating mode during your visit. Please speak in a low voice when using your cell phone.

Illness Policy:

  • Please do not bring your child to Cuddle Avenue Playroom if they are sick, contagious or showing other symptoms of an illness. If your child is recovering from a virus, remember that standard procedure calls for a 24 hours FEVER FREE period, without the aid of medication, once the fever breaks. Your child may visit Cuddle Avenue Playroom only after he/she has been free from signs of illness or symptoms for at least 24 hours. Cuddle Avenue Playroom reserves the right to send a child home to get well.
  • If we see your child(ren) is visibly sick or has a temperature higher than 100.3oF, then they will be refused entry.
  • If your child has allergies, please inform a Cuddle Avenue Playroom staff member and request to include this information on your online account. State of Play does not have a medical staff available and is not permitted to provide emergency or other medical treatment.

COVID-19 Exposure Waiver:

  • All of our staff are vaccinated against COVID-19
  • By making a reservation, you voluntarily assume all risks related to potential exposure to COVID-19 and agree to follow all Cuddle Avenue Playroom protocols during your visit.
  • If you or another person in your party has been diagnosed with or exposed to COVID-19, please contact Cuddle Avenue Playroom to reschedule your visit.
  • As of March 7, 2022, proof of COVID vaccination is no longer required.
  • Face masks are optional.
  • Please note that a new waiver of responsibility is required to be signed by all Cuddle Avenue Playroom participants. This requirement applies to everyone whether you filled out a waiver in the past or not.

Cancellations, Reschedules, Refunds and Fees:

  • All reservations are non-refundable.
  • You may cancel your reservation minimum one hour before the visit.
  • Open Play passes expire 2 months from the day of purchase. No refund will be issued for unused passes.
  • Unused passes (due to cancellation) will be applied to a future visit. No Refunds!!
  • For any No-Shows, your pass will be deducted and cannot be used for future visits. No store credit for No-Shows.
  • Reschedule requests will be accommodated up to 48 hours in advance of appointment.
  • Emergency reschedules may be accommodated due to COVID-19 exposure.
  • a credit card surcharge of 3.9%+ 0.30 cents per transaction is applied to all transactions
  • In the event that Cuddle Avenue Playroom must cancel a reservation, clients will be contacted regarding next steps.
  • If you need to cancel a scheduled class from your semester session registration, please give us a notice of 24 hours. In this case, we will cancel your class and apply a credit to your file for the cancelled class. Your credit will expire 3 months after being issued. In the case of a cancellation happening less than 24 hours before the class, no refund or credit will be possible. Drop-in classes are non-refundable.

Disclaimer of Liability:

  • By purchasing a pass for admission to Cuddle Avenue Playroom, guest acknowledges that she has carefully read this agreement and understands all of its terms, policies and procedures, releases, waivers and indemnification of the facility. Guest agrees to assume all risks of bringing his child to SCuddle Avenue Playroom and that in the event of his child’s illness or injury, Guest has no recourse against Cuddle Avenue Playroom, its employees, agents and officers.
  • All Guests, their children, and their caretakers shall conduct themselves in ways that do not threaten the health, well-being, and full enjoyment of Cuddle Avenue Playroom offerings by other Guests, their children and caretakers. Cuddle Avenue Playroom reserves the right to remove any Guest from the premises for conduct that is judged to be detrimental to the welfare of other Guests. This includes the right to refuse a child’s participation in any class, program or service due to the child’s continued behavioral problems.
  • Cuddle Avenue Playroom is not liable for any harm or loss to persons or property. Any protection exercised or offered by Cuddle Avenue Playroom shall be deemed purely gratuitous on its part and shall in no way be construed to make it liable for any loss or inconvenience suffered by the Guest. Cuddle Avenue Playroom is not responsible in any circumstances for indirect, consequential or punitive damages.
  • The following rules and regulations apply to all Cuddle Avenue Playroom facilities and may be amended at the discretion of Cuddle Avenue Playroom management. On all questions regarding the interpretation of rules and regulations, the decision of Cuddle Avenue Playroom shall be final. Cuddle Avenue Playroom reserves the right to suspend visitor privileges for violation of any rule or regulation.

Party Policies:

  • Party space rentals include use of full indoor space at Cuddle Avenue Playroom for 40 people.
  • After submitting a party space rental request we will get back to you within 3 days from your request.
  • After talking with you, Cuddle Avenue will send you a contract by email, and process your credit card deposit of $150. The remaining balance will be charged before your party.
  • Your date is not final or your party booked until Cuddle Avenue receives a signed contract and deposit. Parties must be booked at least 5 days in advance.
  • Space will be furnished with tables and chairs for all your guests.
  • Please note that Cuddle Avenue staff members are not able to serve food or drink at your event. Renters should plan to set up and serve their own food and drink.
  • Guests may bring their own food and non-alcoholic drinks. Food may be delivered to Cuddle Avenue Playroom. Choose from a local vendor or hire your own catering partner.
  • Birthday parties may be rescheduled up to 30 days before the event at a cost of $50. Cuddle Avenue will make every effort to accommodate rescheduling; however, dates and times are subject to availability.
  • Birthday parties may be canceled up to 60 days in advance of the party date with no penalty or cost aside from the deposit. Parties that are canceled fewer than 60 days ahead will be issued a partial refund excluding the deposit as outlined in the contract.
  • Once the deposit is made, our cancellation policy stated on the Dream City Party Agreement will take effect immediately.
  • Prices do not include tax. 10% gratuity and service charge will apply to your total costs.

Cuddle Avenue Playroom POLICIES AND ASSUMPTION OF RISK, WAIVER, AND RELEASE

The individual named below (referred to as "I" or "me") desires of being permitted to enter the premises of and/or participate in supervised play activities (the "Activities") at, and, if applicable, for his or her minor children to enter the premises of and/or participate in the Activities at, Cuddle Avenue Playroom, located at Address (“Cuddle Avenue Playroom”), provided by Company Name, a New York corporation (the "Company"). As lawful consideration for being permitted by the Company to enter Cuddle Avenue Playroom premises and participate in the Activities, I agree to all the terms and conditions set forth in this agreement (this "Agreement").

Policies and Procedures (Subject to change at any time without prior notice)

  1. I assume full responsibility for my own safety and conduct, and the supervision, safety, and conduct of my child(ren), while on or about Cuddle Avenue Playroom. I will remain on the premises at all times while my child(ren) is/are on premises and/or participating in the Activities.
  2. LIMIT THREE (3) CHILDREN PER ADULT.
  3. Please read all signs posted throughout Cuddle Avenue Playroom and note the age restrictions in each exhibit/play area.
  4. Cuddle Avenue Playroom is designed for children under five (5) years of age. The Company reserves the right to refuse admittance to any child(ren) over five (5) years of age and/or who do not fit the height and size requirements applicable to the Activities.
  5. For safety reasons, children between five (5) and eighteen (18) years of age are not permitted to enter into the designated play areas (the “Playspace”). Any child entering into the playspace must be accompanied by a parent or guardian at all times.
  6. ALL ADULTS AND CHILDREN MUST WEAR SOCKS WHILE IN THE PLAYSPACE. Socks are available for purchase. Outdoor footwear is prohibited in the Playspace. The Company reserves the right to refuse entrance to the Playspace to anyone who does not have the proper footwear.
  7. Please do not bring any child(ren) into Cuddle Avenue Playroom when they are ill or have a communicable medical condition. The Company reserves the right to restrict and/or refuse a child’s admission in the event the Company determines, in its sole and absolute discretion, the child is ill and/or presents a risk to the health or wellbeing of others.
  8. While on or about Cuddle Avenue Playroom premises, I and my child(ren) will conduct ourselves in a manner that does not threaten the health, wellbeing or full enjoyment of others.
  9. No rough play or fighting while on or about the playspace or Cuddle Avenue Playroom premises. The Company does not tolerate bullying, fighting and/or rough/horse play and reserves the right to refuse admittance to any individual involved in bullying, fighting, rough/horse play and/or disrespecting others. In the event the Company determines, in its sole and absolute discretion, an individual is acting in violation of this policy, such individual (and, if applicable, his/her/their parent(s), guardian(s), and/or child(ren)) will be asked to exit the premises and will not be entitled to a refund of any amounts incurred in connection with the Activities, including admission to Cuddle Avenue Playroom and/or other Activity-related fees.
  10. The Company will make reasonable efforts to monitor and reserves the right to limit the number of people who occupy any area of Cuddle Avenue Playroom.
  11. No food or beverage, including gum and candy, may be brought into the Playspace or designated areas.
  12. Cuddle Avenue Playroom is a nut free facility. Please do not bring or consume on premises any nuts or products that contain nuts.
  13. Please respect the equipment, the toys, and others. No sharp or glass objects allowed in the Playspace or Cuddle Avenue Playroom premises.
  14. The Company is not responsible for loss, theft or damage of any personal property. Do not leave valuables or personal belongings unattended.
  15. The Company reserves the right to open and close the premises or any portion of the playspace in its sole and absolute discretion. Posted hours are subject to change without prior notice for construction, maintenance, special events, holidays, or other purposes. In the event a portion of the playspace is closed, I agree I shall not be entitled to a refund of any amounts, including pro rata with respect to such closed portion(s).
  16. Any individual desiring entrance to the playspace and participation in the Activities, including parents, guardians, or other individuals over eighteen (18) years of age, must agree to the terms and conditions herein in order to gain entry.

Assumption of Risk, Waiver, and Indemnification

I AM AWARE AND UNDERSTAND THAT ENTRY INTO CUDDLE AVENUE PLAYROOM AND PARTICIPATION IN THE ACTIVITIES INVOLVE DANGER AND THE RISK OF PROPERTY DAMAGE AND/OR SERIOUS INJURY, INCLUDING BUT NOT LIMITED TO FALLING, BUMPING, RISKS FROM ABRASIONS, SCRAPES, CUTS, BURNS, BROKEN, SPRAINED OR BRUISED LIMBS, AND EVEN MORE SERIOUS INJURIES SUCH AS PARALYSIS OR DEATH, WHICH DANGERS AND RISKS I VOLUNTARILY ASSUME. I ACKNOWLEDGE THAT ANY INJURIES I OR MY CHILD(REN) SUSTAIN MAY BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANY. I ACKNOWLEDGE AND HEREBY VOLUNTARILY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHERWISE.

I hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its officers, directors, affiliates, agents, employees, shareholders, successors and assigns (“Releasees”) from all liability to me, my personal representatives, assigns, heirs, and next of kin for any loss or damage, and any claim or demands therefor, on account of injury, death, or property damage, arising out of or attributable to my presence in, upon, or about Cuddle Avenue Playroom, whether in connection with my participation in the Activities and whether caused by the negligence of Releasees or otherwise. I covenant not to make or bring any such claim against the Company or any other Releasees, and forever release and discharge the Company and all other Releasees from liability under such claims.

Furthermore, I shall defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, injuries, illnesses, medical conditions, damages, actions, claims, liabilities, judgments, awards, interest, penalties, fines, costs, or expenses of whatever kind, including attorney’s fees and court costs, fees and costs of enforcing any right to indemnification under this Agreement, and the cost of pursuing any insurance providers, arising out of or resulting from any negligent, grossly negligent, or deliberate act or omission by my child(ren) or myself.

  • I understand that this is a permanent waiver to be kept on file by Cuddle Avenue Playroom for today’s visit and all subsequent and future visits.
  • I expressly agree that the Company may use photos and/or video taken of children and/or caregivers at Cuddle Avenue Playroom for archival and publicity purposes. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice or conflict of law provision or rule. I further expressly agree that this Agreement is intended to be as broad and inclusive as is permitted by the law of the State of New York and that, if any portion hereof is held invalid, it is agreed that the balance shall continue in full legal force and effect. I have read and voluntarily sign this Agreement, and further agree that no oral representations, statements, or inducement, apart from the foregoing written agreement, have been made.
